1. Agreement to Terms
By accessing or using The Smart Language platform ("Service"), operated by The Smart Language PTE LTD, a company registered in Singapore, you agree to be bound by these Terms of Service. These terms apply to all users, including individual learners, teachers, educational institutes, and administrators. If you do not agree to these terms, please do not use our Service.
2. Description of Service
The Smart Language is a comprehensive AI-powered language teaching and learning platform. Our services include:
For Students & Individual Learners
- Access to thousands of language learning exercises across reading, writing, speaking, and listening
- AI-powered speaking evaluation with pronunciation, fluency, and content feedback
- AI-powered writing evaluation with grammar, vocabulary, and coherence analysis
- Personalized learning paths and recommendations
- Progress tracking and performance analytics
- 24/7 practice with instant feedback
For Teachers
- Class management and student onboarding tools
- Exercise library with search and filtering capabilities
- AI-assisted grading with teacher override and moderation workflows
- Real-time student analytics and progress monitoring
- Confidence logs and engagement alerts
- Customizable assignments and learning pathways
For Institutes
- Multi-class and multi-teacher administration
- Institution-wide analytics and reporting
- Student outcome tracking and export capabilities

Exam Preparation
We offer exam preparation resources for various certifications and qualifications:
- Language Certifications: IELTS, Cambridge (B2 First, C1 Advanced), DELF/DALF, DELE, TELC, Goethe-Institut, ÖSD, HSK, TOEFL, TOEIC

3. User Types and Account Registration
Individual Accounts
Individual learners may register directly for personal use. You must be at least 16 years old to create an account. Users under 16 must have parental consent and supervision.
Institute Accounts
Educational institutes may register for organizational accounts. The institute administrator is responsible for managing teacher and student accounts within their organization. Institutes represent and warrant that they have the authority to bind their organization to these Terms.
Account Responsibilities
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Providing accurate and up-to-date information
4. Subscription and Payments
Access to our services may require a paid subscription. By subscribing, you agree to:
- Pay the applicable subscription fees as displayed at the time of purchase
- Automatic renewal of your subscription unless cancelled before the renewal date
- Provide accurate and complete billing information
Payments are processed securely through our authorized payment processor. All prices are displayed in EUR unless otherwise specified. Institute pricing may be customized based on usage and requirements.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You agree not to:
- Share your account credentials with unauthorized users
- Allow multiple individuals to use a single account (unless explicitly permitted by your subscription type)
- Reproduce, distribute, or resell our content without permission
- Attempt to reverse engineer, decompile, or extract our proprietary technology or AI models
- Use the Service for any unlawful purpose or to harm others
- Interfere with or disrupt the Service, servers, or networks
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorized access to any part of the Service
- Use automated tools to scrape or extract data from the Service
- Misrepresent your identity or affiliation
6. Content and Intellectual Property
Our Content
All content, features, and functionality of the Service—including exercises, assessments, AI models, software, design, and branding—are owned by The Smart Language and are protected by international copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal or authorized institutional purposes.
User Content
You retain ownership of content you submit (such as writing assignments and speaking recordings). By submitting content, you grant us a license to process, store, and analyze it for the purpose of providing our services. We do not use your content to train AI models.
7. AI-Generated Content & Disclaimer
Our Service uses artificial intelligence to provide evaluations, feedback, and personalized recommendations. By using our Service, you acknowledge and agree to the following:
- AI-Generated Assessments: All evaluations, scores, and feedback provided by our platform are generated by artificial intelligence systems, not human examiners (unless explicitly stated).
- Educational Purpose Only: Our AI assessments are designed solely for educational and practice purposes to help learners improve and prepare for official certification exams.
- No Official Standing: Our AI evaluations do not constitute official certification results and should not be used as proof of language proficiency for any official, legal, employment, immigration, or academic purposes.
- No Real-Life Consequences: You should not rely on our AI assessments to make decisions with real-life consequences. Always obtain official certification through accredited examination centers.
- Accuracy Limitations: While we strive for accuracy, AI systems have inherent limitations. Actual official exam results may differ significantly from our practice assessments.
- Teacher Override: For institutional users, teachers may review and override AI-generated grades. Final grades in such cases reflect teacher judgment.
We do not use your submissions to train AI models. Your data is processed for evaluation purposes only and is not retained for machine learning. You may request deletion of all your data at any time by emailing delete@thesmartlanguage.com. See our Privacy Policy for details.
We are committed to transparency about our use of AI technology.
8. Institute-Specific Terms
If you are an educational institute using our platform:
- You are responsible for ensuring appropriate use by teachers and students within your organization
- You must obtain necessary consents for student data processing in accordance with applicable laws
- Student data belongs to the institute and students; we process it only to provide our services
- You may export your data at any time through available export features
- Upon termination, we will assist with data export and deletion as requested
9. Limitation of Liability
The Smart Language shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:
- Exam results that differ from AI assessments provided by our platform
- Decisions made based on AI-generated feedback or scores
- Service interruptions or data loss
- Third-party actions or content
Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding any claim.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:
- You will retain access until the end of your current billing period
- You may request export of your data before account closure
- We will delete your data in accordance with our Privacy Policy upon request
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service at least 30 days before changes take effect. Continued use after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes shall be resolved in the courts of Singapore.
